Terms of Service
Last Updated: July 23, 2026
Overview
This website is operated by TinyRacer.
Throughout these Terms of Service, the terms “TinyRacer,” “we,” “us,” and “our” refer to TinyRacer. The terms “you” and “your” refer to any visitor, customer, purchaser, account holder, or other user of the website.
TinyRacer provides this website, including its product listings, information, content, features, tools, customer support, and online shopping services, subject to your acceptance of these Terms of Service and all other policies referenced in them.
By accessing our website, browsing our products, creating an account, placing an order, submitting information, or otherwise using our services, you agree to be bound by these Terms of Service.
These Terms apply to all users of the website, including browsers, customers, purchasers, vendors, suppliers, and contributors of content.
Please read these Terms carefully before using the website. If you do not agree with them, you must not access the website, place an order, or use our services.
Nothing in these Terms is intended to exclude, restrict, or waive any consumer right or legal remedy that cannot lawfully be excluded, restricted, or waived.
1. Eligibility and Age Requirements
You must be at least the age of legal majority in your state, province, territory, or country of residence to place an order independently.
A person under the age of legal majority may use the website or purchase products only with the involvement, permission, and supervision of a parent or legal guardian.
By placing an order, you represent that:
-
You are legally capable of entering into a binding agreement
-
You are authorized to use the payment method provided
-
The information you submit is accurate and complete
-
You will use the products lawfully and responsibly
Certain RC vehicles, batteries, tools, chemicals, paints, adhesives, electronic components, and small parts may not be appropriate for children. Customers are responsible for reviewing all product age recommendations, safety warnings, and manufacturer instructions.
2. Online Store Terms
You may not use the website, our services, or products purchased from TinyRacer for any unlawful, fraudulent, abusive, or unauthorized purpose.
You may not violate any applicable law, regulation, carrier requirement, intellectual property right, product safety rule, import restriction, or third-party right while using our services.
You must not:
-
Submit false, misleading, or fraudulent information
-
Use a payment method without authorization
-
Attempt to interfere with website security or operation
-
Introduce viruses, malware, harmful code, or automated attacks
-
Scrape, copy, harvest, or extract website content without authorization

Use the website to facilitate unlawful resale, fraud, or prohibited activity
-
Attempt to bypass purchasing limits, fraud controls, or security measures
-
Make false claims regarding delivery, damage, defects, or returns
-
Abuse promotional codes, discounts, returns, chargebacks, or customer support
A material breach of these Terms may result in order cancellation, account suspension, refusal of service, or other appropriate action, subject to applicable law.

Full-size vehicles
-
Aircraft carrying people
-
Medical equipment
-
Emergency systems
-
Life-support systems
-
Public-road transportation
-
Industrial safety systems
-
Any application where failure could create an unreasonable risk of serious injury, death, or substantial property damage
4. RC Product Safety
RC vehicles and components may move at high speeds, contain small parts, generate heat, rotate rapidly, or create impact, fire, electrical, chemical, and mechanical hazards.
Customers must:
-
Read and follow all manufacturer instructions
-
Observe stated age recommendations
-
Use appropriate adult supervision
-
Operate RC vehicles in safe and permitted locations
-
Keep people, animals, vehicles, and property clear of moving products
-
Inspect products before use
-
Stop using products that appear damaged or unsafe
-
Wear appropriate protective equipment where necessary
-
Keep small parts away from children and pets
-
Follow applicable local laws and facility rules
RC vehicles should not be operated on public roads, near traffic, crowds, airports, emergency operations, restricted areas, or locations where use is prohibited or unsafe.
TinyRacer is not responsible for unsafe, unlawful, reckless, competitive, modified, or unintended product use to the extent permitted by law.
5. Batteries, Chargers, and Electronic Components
Rechargeable batteries, chargers, motors, electronic speed controllers, receivers, servos, wiring, and related electronic products must be used only with compatible equipment and according to manufacturer instructions.
You are responsible for confirming:
-
Battery chemistry
-
Cell count
-
Voltage
-
Capacity
-
Discharge rating
-
Connector type
-
Charger compatibility
-
Motor and ESC limits
-
Wiring polarity
-
Product dimensions
-
Installation requirements
Never use a battery, charger, or electronic component that is swollen, punctured, leaking, crushed, unusually hot, wet, visibly damaged, or otherwise unsafe.
Do not:
-
Leave batteries charging unattended
-
Charge batteries on or near combustible materials
-
Use an incompatible charger or charging mode
-
Exceed manufacturer voltage or current limits
-
Short-circuit battery terminals
-
Modify battery cells or protective wrapping
-
Charge or use a damaged battery
-
Dispose of batteries in ordinary household waste where prohibited
-
Allow children to charge batteries without qualified adult supervision
Immediately stop using a product if it emits smoke, sparks, excessive heat, unusual odors, or other signs of failure.
TinyRacer does not provide professional electrical, engineering, battery-management, or fire-safety services. Product support information does not replace the manufacturer’s instructions or qualified technical assistance.
6. Product Compatibility
RC vehicle parts may differ according to:
-
Brand
-
Model
-
Production version
-
Scale
-
Dimensions
-
Mounting pattern
-
Gear pitch
-
Shaft diameter
-
Connector type
-
Voltage
-
Battery chemistry
-
Electronic specifications
-
Existing modifications
A scale description such as 1/10, 1/18, or 1/24 does not, by itself, guarantee compatibility with every vehicle of that scale.
Before purchasing, you are responsible for reviewing:
-
Product title and description
-
Measurements and specifications
-
Compatibility information
-
Part numbers
-
Connector and voltage requirements
-
Photographs
-
Manufacturer documentation
-
Your vehicle’s current configuration
Compatibility assistance from TinyRacer is based on information supplied by the customer and product information available to us. It does not guarantee compatibility when information is incomplete, inaccurate, outdated, or affected by aftermarket modifications.
TinyRacer is not responsible for damage caused by installing or using an incompatible component to the extent permitted by law.
7. Accuracy of Product Information
We make reasonable efforts to present product titles, descriptions, photographs, measurements, specifications, compatibility information, availability, and prices accurately.
However:
-
Product photographs may be illustrative
-
Colors may appear differently depending on the screen or device
-
Packaging may change
-
Manufacturers may update specifications or designs
-
Measurements may include reasonable tolerances
-
Minor cosmetic differences may occur
-
Product information supplied by manufacturers or distributors may be incomplete or updated
You should not rely solely on photographs when compatibility, dimensions, voltage, connector type, or technical specifications are important.
Nothing in this section limits your rights when a product is materially different from its description, incorrectly supplied, defective, or otherwise subject to a legal remedy.
8. Product Images and Colors
We attempt to display product images and colors as accurately as reasonably possible.
We cannot guarantee that a computer monitor, mobile device, browser, display setting, lighting condition, or photograph will reproduce the exact physical color of a product.
Minor color, finish, packaging, labeling, or design variations that do not materially change the product’s identity or functionality may not constitute a defect.
Materially different products remain subject to our Return & Refund Policy and applicable law.
9. Third-Party Brands and Compatibility References
TinyRacer may refer to third-party brands, models, product names, part numbers, and trademarks to describe product compatibility or intended use.
All third-party names, logos, trademarks, and product identifiers belong to their respective owners.
Unless expressly stated otherwise:
-
TinyRacer is not affiliated with, sponsored by, endorsed by, or officially connected with those third-party brand owners
-
Compatibility references are provided only to identify the intended or possible use of a product
-
The presence of a third-party trademark does not mean that the product was manufactured or approved by the trademark owner
Customers must independently verify compatibility before purchase and installation.
10. Product Availability
Product availability may change without notice.
Adding a product to a shopping cart, wishlist, or account does not reserve inventory.
After an order is placed, a product may become unavailable because of:
-
Inventory changes
-
Supplier availability
-
Listing errors
-
Product discontinuation
-
Shipping restrictions
-
Safety concerns
-
Regulatory restrictions
-
Fulfillment limitations
If an item cannot be fulfilled, we may:
-
Cancel the affected item
-
Contact you regarding a delay
-
Offer an alternative with your consent
-
Issue an appropriate refund
We will not knowingly substitute a materially different product, color, voltage, connector, model, or specification without your agreement.
11. Prices and Price Changes
Product prices may change at any time before an order is accepted.
A price change will not ordinarily affect an order that has already been accepted, except where:
-
There is an obvious pricing or listing error
-
The customer agrees to a change
-
A correction is required by law
-
The order is otherwise lawfully canceled and refunded
Prices displayed on the website do not necessarily include taxes, duties, brokerage charges, customs fees, or other government charges unless expressly stated.
TinyRacer does not guarantee that a current price will remain available for future purchases.
12. Pricing and Listing Errors
Occasionally, a product may be listed with an incorrect:
-
Price
-
Discount
-
Description
-
Image
-
Quantity
-
Specification
-
Availability status
-
Shipping charge
-
Promotional term
If we discover a material error before an order is fulfilled, we may contact you for instructions or cancel the affected order.
If payment has already been collected for an order that we cancel, we will issue an appropriate refund to the original payment method.
We will not charge a corrected higher price without your agreement.
Nothing in this section permits TinyRacer to engage in misleading pricing or remove rights that cannot legally be waived.
13. Orders and Order Acceptance
Submitting an order is an offer to purchase the selected products under these Terms.
An automated order confirmation confirms that we received the order. It does not necessarily mean that the order has been finally accepted or shipped.
An order may be reviewed for:
-
Payment authorization
-
Fraud prevention
-
Address accuracy
-
Product availability
-
Shipping restrictions
-
Quantity limitations
-
Pricing or listing errors
-
Legal or safety concerns
Unless otherwise required by applicable law, order acceptance generally occurs when we send a shipping confirmation or otherwise expressly confirm acceptance.
We reserve the right to decline or cancel an order for a legitimate reason, including:
-
Product unavailability
-
Suspected fraud
-
Unauthorized payment
-
Incorrect customer information
-
Shipping restrictions
-
Safety concerns
-
Material listing or pricing errors
-
Unusually large quantities
-
Suspected unlawful resale or misuse
-
Violation of these Terms
If a canceled order has been charged, an appropriate refund will be issued.
14. Order Quantity Limits
We may limit or cancel quantities purchased per person, household, account, payment method, shipping address, billing address, or order.
Quantity limits may be applied to:
-
Products with limited inventory
-
Promotional items
-
Batteries or restricted products
-
Products subject to resale abuse
-
Products affected by safety or shipping restrictions
-
Orders presenting fraud or payment risk
Where reasonably possible, we will notify you if an order is limited or canceled.
15. Payment
You agree to provide current, complete, and accurate billing and payment information.
By submitting payment information, you represent that:
-
You are authorized to use the selected payment method
-
The payment information is accurate
-
You authorize applicable charges for the order
-
You will pay all properly disclosed charges
Payment authorization does not guarantee order acceptance.
Your bank, card issuer, or payment provider may place temporary authorization holds. TinyRacer does not control how long a financial institution maintains a pending authorization.
TinyRacer does not directly store complete payment card information when payment is processed by an authorized payment provider.
16. Taxes, Duties, and Customs Charges
Applicable sales tax or similar transaction tax may be calculated and collected during checkout where required.
For international orders, customers may also be responsible for:
-
Import duties
-
Value-added tax
-
Customs fees
-
Brokerage fees
-
Inspection charges
-
Other government or carrier charges
Unless expressly stated as included at checkout, these charges are not included in the product price or standard shipping fee.
Customers are responsible for reviewing destination-country import requirements before ordering.
17. Shipping and Delivery
Order processing, shipping fees, tracking, estimated delivery times, address changes, split shipments, delayed shipments, lost packages, international delivery, and battery transportation restrictions are governed by our Shipping & Delivery Policy.
Delivery dates are estimates unless expressly stated otherwise.
If we cannot ship within the timeframe represented at purchase, we will provide applicable delay information and available options, which may include:
-
Agreeing to a revised shipping timeframe
-
Canceling the delayed item or order
-
Receiving a refund for the unshipped item or order
Events outside our reasonable control do not eliminate refund, cancellation, or other rights that apply under mandatory law.
18. Order Changes and Cancellations
Order changes and cancellations are not guaranteed after processing or fulfillment begins.
Customers should submit cancellation, product-change, or address-change requests as soon as possible and preferably within 12 hours after purchase.
A requested change or cancellation is effective only after TinyRacer confirms it in writing.
Once an order has shipped, it generally cannot be canceled. Eligible products may instead be handled under our Return & Refund Policy after delivery.
19. Returns, Refunds, and Exchanges
Returns, refunds, replacements, defective product claims, shipping damage claims, and exchanges are governed by our Return & Refund Policy.
Customers must obtain return instructions before shipping a product back.
Do not send a product to the address printed on the original shipping package unless TinyRacer specifically directs you to use that address.
Products may be fulfilled from different facilities, and the correct return address may differ from the original sender address.
Nothing in these Terms limits a return, refund, replacement, repair, cancellation, or other remedy that cannot legally be excluded.
20. Manufacturer Instructions and Warranties
Products may include instructions, warnings, or warranties provided by the manufacturer.
Customers are responsible for reading and following all manufacturer information.
A manufacturer warranty, when available, is separate from TinyRacer’s voluntary return policy and may include its own:
-
Registration requirements
-
Time limits
-
Exclusions
-
Troubleshooting procedures
-
Repair process
-
Replacement process
-
Documentation requirements
TinyRacer may assist with manufacturer information where reasonably available.
A manufacturer warranty does not eliminate any non-waivable legal rights the customer may have against TinyRacer.
21. Modifications and Aftermarket Use
Modifying an RC product may affect:
-
Performance
-
Reliability
-
Compatibility
-
Safety
-
Manufacturer warranty
-
Return eligibility
-
Legal use
Modifications include:
-
Cutting or soldering wires
-
Replacing connectors
-
Drilling or trimming body shells
-
Reprogramming electronics
-
Changing voltage or battery type
-
Installing higher-powered motors
-
Altering gearing
-
Changing suspension geometry
-
Combining parts not designed to work together
You accept responsibility for determining whether a modification is safe, lawful, and technically appropriate.
TinyRacer is not responsible for damage resulting from unauthorized, incompatible, improper, or unsafe modifications to the extent permitted by law.
22. Professional and Technical Advice Disclaimer
Product descriptions, compatibility assistance, setup suggestions, troubleshooting information, and customer support communications are provided for general informational purposes.
They are not professional engineering, electrical, mechanical, fire-safety, legal, or regulatory advice.
Customers are responsible for:
-
Reviewing manufacturer documentation
-
Confirming technical compatibility
-
Using appropriate tools
-
Following safe installation practices
-
Seeking qualified assistance when necessary
Do not rely on general customer support information where incorrect installation or use could create a significant risk of injury, fire, property damage, or product failure.
23. Independent Suppliers and Fulfillment Providers
TinyRacer may use independent suppliers, warehouses, distributors, payment processors, carriers, and logistics providers to process and fulfill orders.
As a result:
-
Products may ship from different facilities
-
Items from one order may arrive separately
-
Packaging may display information associated with a fulfillment provider
-
Different carriers may be used
The use of an independent service provider does not remove TinyRacer’s obligations under applicable consumer law.
Third-party providers may have separate terms relating to their own services, but those terms do not automatically replace TinyRacer’s published store policies.
24. Third-Party Tools and Services
We may provide access to third-party tools, payment services, tracking services, applications, or website features.
Third-party services may be provided under separate terms and privacy policies.
TinyRacer does not control all aspects of independent third-party services and does not guarantee that every third-party feature will always be available, uninterrupted, or error-free.
Your use of an optional third-party service may be subject to that provider’s terms.
Nothing in this section limits TinyRacer’s responsibility for selecting or using service providers where such responsibility cannot legally be excluded.
25. Third-Party Links
The website may contain links to third-party websites or resources.
A link does not necessarily mean that TinyRacer:
-
Owns the third-party website
-
Controls its content
-
Endorses every product or statement
-
Guarantees its security or availability
You should review the terms, privacy practices, and policies of third-party websites before using them or submitting personal information.
TinyRacer is not responsible for independent third-party content or transactions to the extent permitted by law.
26. Website Content and Intellectual Property
Unless otherwise stated, the website and its original content, including its:
-
Store name
-
Branding
-

-
Graphics
-
Written content
-
Product organization
-
Icons

You may use the website only for personal, lawful shopping and informational purposes.
You may not, without prior written permission:
-
Copy or republish substantial website content
-
Reproduce original graphics or photographs
-
Use TinyRacer branding in a misleading manner
-
Create a confusingly similar store or identity
-
Remove copyright, trademark, or ownership notices
-
Use website content to train, populate, or operate a competing commercial service
-
Sell, license, or commercially exploit website content
Permitted use of third-party trademarks remains subject to the rights of their respective owners.
27. User Submissions and Reviews
If you submit a review, photograph, video, comment, question, suggestion, or other content, you represent that:
-
You have the right to submit it
-
It is accurate to the best of your knowledge
-
It does not infringe another person’s rights
-
It does not contain unlawful, threatening, hateful, fraudulent, defamatory, obscene, or harmful material
-
It does not contain malware or harmful code
-
It does not reveal another person’s private information without permission
You retain ownership of your original content.
By submitting content for publication, you grant TinyRacer a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and distribute that content for operating, improving, and promoting the store, subject to applicable law and our Privacy Policy.
We may remove content that violates these Terms, is unrelated, contains personal information, appears fraudulent, or is otherwise inappropriate.
We will not require reviews to be exclusively positive, and we may distinguish verified purchases from other submissions.
28. Feedback and Suggestions
If you voluntarily provide suggestions, ideas, or general feedback about TinyRacer, you authorize us to use that feedback without an obligation to compensate you.
This section does not transfer ownership of confidential information or intellectual property that you clearly identify and lawfully own.
Do not submit confidential business information, unpublished inventions, or proprietary material unless a separate written agreement is in place.
29. Privacy and Personal Information
The collection, use, retention, sharing, and protection of personal information are governed by our Privacy Policy and any privacy notices presented at the time information is collected.
You are responsible for ensuring that personal information submitted through the website is accurate and that you have authority to provide it.
Do not submit unnecessary sensitive information through order notes, reviews, or customer service messages.
30. Account Security
If account functionality is available, you are responsible for:
-
Maintaining the confidentiality of your login information
-
Using a strong and unique password
-
Restricting unauthorized access to your device
-
Providing accurate account information
-
Notifying us promptly of suspected unauthorized activity
You are responsible for activity conducted through your account unless applicable law provides otherwise or the activity resulted from TinyRacer’s failure to use legally required security measures.
We may suspend or restrict an account when reasonably necessary to protect customers, investigate fraud, or secure the website.
31. Electronic Communications
By using the website, placing an order, or contacting customer support, you agree that we may communicate with you electronically regarding:
-
Order confirmations
-
Payment issues
-
Shipping updates
-
Delivery delays
-
Return requests
-
Refunds
-
Safety notices
-
Policy notices
-
Customer support matters
Transactional communications are necessary to process and administer your order.
Marketing communications, where used, will be handled according to applicable consent and opt-out requirements.
You are responsible for providing an accurate email address and checking filtered, spam, and junk folders.
32. Prohibited Conduct
You may not:
-
Use the website for unlawful or fraudulent activity
-
Attempt unauthorized access
-
Interfere with website operation
-
Introduce malicious software
-
Collect information about other users without authorization
-
Use automated systems in a manner that places an unreasonable burden on the website
-
Circumvent purchasing restrictions or security controls
-
Submit false payment disputes or chargebacks
-
Make knowingly false defect, delivery, or return claims
-
Harass customers, employees, contractors, or service providers
-
Use the website to violate intellectual property rights
-
Resell products in violation of applicable law
-
Use purchased products to create unlawful interference or harm
We may investigate suspected violations and cooperate with payment providers, carriers, law enforcement, regulators, and other authorized parties when legally permitted or required.
33. Service Availability
We aim to keep the website available and functional, but we do not guarantee uninterrupted, continuous, secure, or error-free access.
The website may be unavailable because of:
-
Maintenance
-
Technical failure
-
Hosting problems
-
Cybersecurity events
-
Third-party service interruptions
-
Network failure
-
Legal or regulatory requirements
-
Events outside our reasonable control
We may update, suspend, restrict, or discontinue website features where reasonably necessary.
Temporary website unavailability does not affect existing customer rights relating to paid orders.
34. Errors and Corrections
We may correct errors, inaccuracies, or omissions on the website, including those related to:
-
Product descriptions
-
Pricing
-
Promotions
-
Availability
-
Shipping information
-
Specifications
-
Images
-
Compatibility
-
Policy language
Corrections may be made without prior notice.
Where a correction materially affects an existing order, we will provide an appropriate notice, option, cancellation, or refund as required by the circumstances and applicable law.
35. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the website and its general informational content are provided on an “as available” basis.
TinyRacer does not guarantee that:
-
Website access will always be uninterrupted
-
Every website error will be corrected immediately
-
Every third-party service will remain available
-
General product information will satisfy every individual purpose
-
Products will be compatible with equipment not accurately identified by the customer
Products remain subject to any express description, applicable manufacturer warranty, TinyRacer policy, and non-waivable legal warranty or consumer guarantee.
Nothing in these Terms excludes warranties, guarantees, duties, or remedies that cannot legally be excluded.
36. Limitation of Liability
To the fullest extent permitted by applicable law, TinyRacer will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising solely from:
-
Unlawful or unintended product use
-
Customer-supplied incorrect information
-
Incompatible installation
-
Unauthorized modifications
-
Failure to follow safety instructions
-
Independent third-party websites
-
Events outside TinyRacer’s reasonable control
This limitation does not apply where liability cannot legally be limited or excluded.
Nothing in these Terms excludes or limits liability for:
-
Fraud
-
Willful misconduct
-
Gross negligence where it cannot be limited
-
Death or personal injury where exclusion is prohibited
-
A defective product where statutory liability applies
-
Breach of a non-waivable consumer right
-
Any other liability that applicable law does not permit us to exclude
Any liability limitation will be interpreted only to the maximum extent legally enforceable.
37. Customer Responsibility for Loss
You are responsible for losses reasonably caused by your material violation of these Terms, unlawful conduct, fraudulent activity, infringement of third-party rights, or misuse of the website.
You will not be responsible for losses caused by TinyRacer’s own violation, negligence, unlawful conduct, or matters for which liability cannot legally be transferred.
Nothing in this section requires a consumer to indemnify TinyRacer for claims arising solely from TinyRacer’s acts or omissions where such a requirement would be unlawful or unfair.
38. Recalls and Safety Notices
If you become aware that a purchased product may be subject to a recall, safety warning, or serious defect notice:
-
Stop using the product
-
Follow the recall or safety instructions
-
Keep the product away from children and combustible materials where appropriate
-
Contact TinyRacer with your order number
-
Do not continue charging or using a potentially unsafe battery
We may contact customers regarding recalls, safety warnings, corrective actions, or updated instructions.
Customers are responsible for keeping their contact information reasonably current so that important order-related or safety communications can be delivered.
39. Events Outside Reasonable Control
TinyRacer may be affected by events outside its reasonable control, including:
-
Severe weather
-
Natural disasters
-
Fire
-
War or civil unrest
-
Government action
-
Public health emergencies
-
Transportation interruption
-
Carrier failure
-
Customs delay
-
Labor disruption
-
Power or network failure
-
Supplier interruption
We will make reasonable efforts to communicate material effects on customer orders.
This section does not remove cancellation, refund, delivery, or other consumer rights that continue to apply under mandatory law.
40. Refusal and Termination of Service
We may refuse, suspend, or terminate access to the website or services when reasonably necessary because of:
-
Material violation of these Terms
-
Fraud or unauthorized payment
-
Threats or abusive conduct
-
Security risks
-
Unlawful activity
-
Repeated return or chargeback abuse
-
Attempts to interfere with the website
-
Legal or regulatory requirements
Refusal or termination will not remove obligations relating to previously accepted and paid orders.
Where an order is canceled, any required refund will be processed according to applicable law and our policies.
41. Policy Relationship
These Terms should be read together with TinyRacer’s:
-
Privacy Policy
-
Shipping & Delivery Policy
-
Return & Refund Policy
-
Contact Us page
-
Product-specific terms, warnings, or notices displayed before purchase
Where a product page provides a specific specification, warning, shipping restriction, or return condition, that product-specific information applies to the relevant product.
If a store policy conflicts with a non-waivable legal right, applicable law will control.
42. Changes to the Terms
We may update these Terms to reflect changes in:
-
Store operations
-
Products
-
Technology
-
Payment or shipping services
-
Legal requirements
-
Safety practices
-
Website functionality
The current version will be posted on the website with an updated effective date.
Changes generally apply from the date they are posted and will not retroactively remove rights that already arose under an earlier transaction or applicable law.
Your continued use of the website after an update constitutes acceptance of the revised Terms for future use, to the extent permitted by law.
43. Governing Principles
These Terms and transactions with TinyRacer are governed by the laws that lawfully apply to the store operator, the transaction, and the customer.
Any mandatory consumer protection rights available in the customer’s place of residence remain unaffected.
Nothing in these Terms requires a customer to bring a claim in a location where such a requirement would be unlawful or unenforceable.
44. Severability
If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be limited or removed only to the minimum extent necessary.
The remaining provisions will continue in effect where legally possible.
45. No Waiver
If TinyRacer does not immediately enforce a provision of these Terms, that does not mean the provision has been waived.
A waiver is effective only when clearly made in writing by an authorized representative and only for the specific matter addressed.
46. Assignment
You may not transfer your rights or obligations under these Terms where the transfer would materially affect TinyRacer or another party without prior written consent.
TinyRacer may transfer its rights and obligations as part of a lawful sale, merger, restructuring, or transfer of the business, provided that customer rights are not unlawfully reduced.
47. Entire Agreement
These Terms, together with the policies and notices expressly incorporated into them, form the agreement between you and TinyRacer regarding use of the website and purchases made through it.
They replace prior general discussions or representations about the same subject, except for a separate written agreement expressly signed by an authorized representative.
Any ambiguity will not automatically be interpreted against either party solely because one party prepared the language.
48. Contact Information
